LMIA Based Work Permit

Immigrants’ applications for work permits in Canada are increasing with each passing year. This opens the door to more chances for immigrants with a valid job offer. To make this possible and to enable immigrants realize their dream of working in Canada, the government has offered an option for LMIA-based work permits for them.

A Labour Market Impact Assessment (LMIA) allows Canadian firms to engage Temporary Foreign Workers (TFW). LMIA acts as evidence of the inability of Canadian citizens or permanent residents to fill a given position, hence increasing opportunities for international personnel.

An LMIA may only be requested by a Canadian employer; a foreign national is not permitted to request one. The majority of Canadian Temporary Foreign Worker Programme (TFWP) streams require the employer to get an LMIA in order to engage employees from outside Canada, despite the fact that there are some circumstances in which the foreign workers are excluded from this requirement.

LMIA Based work permit process

To get an LMIA-based work permit, a foreign national must follow a regular two-step procedure:

Step 1: Employers submit an application for LMIA for TFW

In this step, it is determined if the TFW will be offered a high-wage post or a low-wage one. One must confirm whether the income offered is higher or lower than the typical provincial median average rate in order to determine this.

Step 2: The TFW submits an application for a work visa.

The second round of the LMIA application includes the recruitment process. Before providing the position to a TFW, the employer must carry out and show proof of recruitment efforts made to employ Canadian citizens or permanent residents.
